According to the Chamber of Industry and Commerce, trailers usually require a special use permit from the road construction authority if the trailer is parked in public space and serves the sole purpose of advertising. The decisive factor for deciding on a special use is therefore whether the parking of an advertising trailer predominantly serves traffic purposes or not. The use of mobile advertising spaces that are not fixed in place still falls under public use and does not require a permit. If advertising trailers are erected on private property, they are considered fixed advertising installations and require a building permit if they are visible from the public space.
Where and for how long may an advertising trailer be parked?
Basically, a distinction must be made as to whether the parking location is within or outside of built-up areas. If the trailer is used for public purposes, it may be parked in the same place for up to 14 days in accordance with § 12 of the Road Traffic Regulations (StVO). If the trailer is parked predominantly for advertising purposes, this is not parking within the meaning of the StVO and, as already mentioned, a special use permit for trailer advertising is therefore required. If this is granted, the trailer may remain at the parking location for longer than 14 days.
Outside built-up areas, all advertising is prohibited if it endangers or distracts road users. In particular, the parking of advertising trailers on bridges over motorways, federal and state roads is prohibited. Exceptions apply to advertising installations directly on company buildings as well as on airfields, sports facilities and the like.
